When you purchase from OptiModo Marketing you agree to our terms and conditions. We hold the right to change these terms, we advise to regularly check them.

OptiModo Marketing takes all payments in advanced of the plan. If you take a monthly plan the payment will come out from a Direct Debit every month. If this payment is not made the next month will not be continued until payment is made. OptiModo Marketing uses a payment partner Go-Cardless. If a monthly contract is taken out it will need to be in writing and the next payment will be cancelled.

Clients of OptiModo Marketing must write to us a minimum of 5 working days before the next payment in order to guarantee the monthly payment is stopped. If they don’t they will be liable to pay the next month.

OptiModo Marketing to NOT offer refunds, once the plan is paid and started we (OptiModo Marketing) assume you want to continue the plan until the agreed minimum term lengths.

All content which OptiModo Marketing produces will be copyrighted to the account holder/holders unless this is clearly stated beforehand. OptiModo Marketing holds to rights to reuse content unless the client has copyright held.

We at OptiModo Marketing make sure we stay on top of all GDPR rules, by agreeing to the services you give us (OptiModo Marketing) the rights to use your data internally to help us provide the service to you.

The use of sensitive data is passed through a double factor authentification system in order to keep your data safe. OptiModo Marketing uses third-party apps to do this and can not be held responsible for any information sent via emails or other means of communication. Once a client decides to terminate their plan with OptiModo Marketing we will be deleted but information for marketing purposes will be withheld.

OptiModo Marketing aims to respond to all clients within 24 hours but does not hold any responsibility for damages or losses should we take 24 hours to respond. The owner of the accounts holds all liability.

All clients are the responsibility for replying to the public in comments, messages which have been sent to the accounts. OptiModo Marketing holds no responsibility for this, this also includes all emails sent to your account.

OptiModo Marketing are not liable to any of the damages caused should any of the information published to your social media, email or website be inaccurate.

We advise that all websites are backed up to a local drive before handing over to OptiModo Marketing in case of any accidents. OptiModo Marketing will also pass on any extra costs which have occurred during the website service this could be application add ons or extra items.

We hold the right to change our Terms and Conditions and Privacy Policy with or without any notice. If you continue to use our services we assume your acceptance of these updates.

If there is a change in pricing OptiModo Marketing will alert the customer 90 days before the change.


1. Entire Agreement:

These terms and conditions, along with the Privacy Policy, represent the entire understanding between the parties. They override any previous agreements, conversations, or arrangements relating to these terms and conditions.


2. Changes to Terms:

We reserve the right to revise these terms and conditions periodically. The most recent version will be effective from the date of publication on our website. Please check them regularly for updates.


3. Non-Transferable Rights:

You may not transfer any of your rights under these terms to another individual. However, we can transfer our rights if we believe that your rights won’t be impacted.


4. Governing Law:

This Agreement is governed by the laws of England and Wales. Any disputes, including non-contractual claims, will fall under the exclusive jurisdiction of the English and Welsh courts.


5. Contracts (Rights of Third Parties) Act 1999:

The provisions of the Contracts (Rights of Third Parties) Act 1999 do not apply to these terms. Thus, no third party has the right to enforce any term of this agreement.


6. Payment Policy:

All services are payable in advance once you receive the invoice. No credit is provided, and refunds are not available unless authorised in writing by OptiModo Marketing Limited.


7. Cancellation Policy:

A notice period equal to the agreed payment plan is needed to terminate services. Monthly plans require a one-month notice, quarterly plans need three months, and annual plans need twelve months. Refunds are only provided if confirmed in writing.


8. Client Responsibilities:

It’s the client’s duty to inform OptiModo Marketing Limited of any inability to meet project deadlines or appointments. If notice is not given within 48 hours of a confirmed session or deadline, it will be counted as part of the digital marketing package without a refund or credit.


9. Service Termination:

OptiModo Marketing Limited reserves the right to terminate a client’s package in writing based on the payment plan. All materials and content cannot be disclosed to third parties without written consent.


10. Indemnification and Liability:

OptiModo Marketing Limited accepts no liability for any financial loss. Delays, actions, or omissions do not constitute a waiver of any rights or remedies. OptiModo Marketing Limited is not liable for any violations of marketing rules, regulations, laws or liabilities incurred by the customer. The customer assumes full responsibility for compliance with all applicable laws and regulations.


3X ROI Guarantee:

OptiModo Marketing guarantees a 3X return on investment (ROI) for our packages. If the guaranteed ROI is not achieved, we will work for free under the conditions outlined below.


Eligibility for Free Work:

Clients will be eligible for OptiModo Marketing to work for free for a maximum of one month if both of the following conditions are met:


The client has been working with OptiModo Marketing for at least three months.

The client has spent £6,000 or more on advertising with OptiModo Marketing.

Evidence Requirement:

To qualify for the free work, clients must provide evidence that both conditions have been met. OptiModo Marketing reserves the right to verify the advertising spend and the duration of the working relationship.


Free Work Period:

If eligible, the free work period will last for a maximum of one month. After this period, normal billing resumes unless otherwise agreed in writing.


No Refunds:

OptiModo Marketing does not issue refunds under any circumstances.


Right to Terminate or Reject:

OptiModo Marketing reserves the right to terminate the agreement or reject the application for a free month if the client is not fulfilling OptiModo Marketing’s terms and conditions or does not collaborate effectively during the free work period. Additionally, if the client is not following the tasks suggested by OptiModo Marketing to a certain standard and this results in not reaching the ROI, they will be ineligible for the guarantee.


Dispute Resolution:

In the event of a dispute regarding the 3X ROI guarantee, the client agrees that OptiModo Marketing will perform the calculation of the ROI. This calculation will include all aspects of the marketing campaigns that OptiModo Marketing has managed.


General Terms:

These terms and conditions are subject to change without notice. Clients will be notified of any changes to these terms and conditions.
